Terms of use
These general terms and conditions of use define the terms and conditions under which any person (‘the Customer’) orders and purchases products sold by Boucle d'Or Pâtisserie (‘Boucle d'Or Pâtisserie’), as part of an online sales system, for goods defined in the sales catalogue on the website www.lespatisseriesdeboucledor.com (‘the Website’).
APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE
These Terms of use are brought to the Customer's attention to enable them to place an order.
Placing an order on the Website and confirming the order constitutes full and complete acceptance of these Terms, which shall be solely applicable to the contract that follows.
Boucle d'Or Pâtisserie reserves the right to modify all or part of these Terms at any time.
CHARACTERISTICS OF THE GOODS OFFERED
The products offered to the Customer are those listed on the Website, subject to availability and the proper functioning of the Website.
All products presented are accompanied by a photograph and a description. These are intended to present the essential characteristics of the products to the Customer before the final order is placed and cannot under any circumstances engage the responsibility of Boucle d'Or Pâtisserie. The photographs of the products are provided for information purposes only. There may be slight differences between the product delivered and the product photo on the Website.
ORDER PLACEMENT AND CONFIRMATION
When placing an order on the Website, a Customer Account is created by entering two identifiers: an email address and a password. These identifiers are confidential.
The username and password are proof of the Customer's identity and commit them to any order placed by them. The Customer is solely responsible for their login details and password.
To place an order, the Customer undertakes to fill in all the details of their order. As such, they undertake to fill in all the various sections necessary for the proper processing of their order.
The Customer is advised to check the details of their order and the total price (excluding VAT and including VAT) and to correct any errors before confirming their acceptance. This confirmation implies acceptance of all of these General Terms and Conditions of Sale and constitutes proof of the sales contract.
It is therefore the Customer's responsibility to check the accuracy of the order and to report any errors immediately.
Boucle d'Or Pâtisserie will confirm the order and its payment:
- On the Website, following payment
- By email, to the email address provided by the Customer
The sale will only be considered final after Boucle d'Or Pâtisserie has sent the Customer confirmation of acceptance of the order by email and after full payment of the order price has been received.
Any order placed on the Website constitutes the formation of a distance contract between the Customer and Boucle d’Or Pâtisserie.
Boucle d’Or Pâtisserie reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding payment for a previous order.
Modifying a cake order:
In the event of a modification or cancellation of the order, the Customer must contact Boucle d’Or Pâtisserie by email: blandine@lespatisseriesdeboucledor.com or by telephone: 0033626031284. :
- up to 5 days before collection, a credit note for the corresponding amount will be sent to the Customer by email.
- less than 5 days before dispatch or collection, no refund will be possible. If a cake is ordered, no refund can be made once it has been prepared and produced following confirmation of the order.
The modification or cancellation of the order is recorded from the moment of notification (by email or telephone) by Boucle d'Or Pâtisserie, and not from the date of dispatch by the Customer.
Boucle d'Or Pâtisserie reserves the right to refuse an order in the event of a breach by the customer of any of its obligations and, more generally, to refuse any order that is abnormal or incomplete for any reason whatsoever, or for any reason specific to its organisation.
Booking a baking workshop and gift cards:
All workshop bookings are firm and final and cannot be postponed for any reason. No refunds will be given.
If you are unable to attend the workshop, you can offer it to a friend.
Workshop gift vouchers can be purchased on the website and in-store. They are valid for 6 months from the date of purchase.
PAYMENT METHOD
The price is payable in full on the day the Customer places the order.
Payment for products is made by VISA or MASTERCARD credit card. Credit card payments are validated immediately.
To be registered, the order must be paid in full. Unpaid orders cannot be processed.
ORDER FORMS AND INVOICES
Through its host Wix, Boucle d’Or Pâtisserie stores order forms and invoices in its computer system.
Wix's computerised records constitute a reliable and durable medium that can be produced as evidence.
AVAILABILITY AND STOCK OUTAGES
The Boucle d’Or Pâtisserie products sold on the website are handmade. They are therefore available in limited quantities and are offered while stocks last.
In the event of a stock shortage or temporary inability to ensure production, Boucle d’Or Pâtisserie will contact the Customer by telephone or email as soon as possible to agree with them:
- to postpone delivery until the product is back in stock
- replacing the product with another of equivalent quality and price
- issuing a refund, if applicable.
SHOP PICK-UP
The Customer agrees to pick up their order at the shop, the address and opening hours of which are listed on the Website.
If the Customer does not show up on the day of pick-up and does not contact Boucle d'Or Pâtisserie, Boucle d'Or Pâtisserie cannot guarantee that the order will still be available. The Customer will not be entitled to any refund in this case.
